KANSAS CITY, Kan.—Dow Chemical Co. is appealing a $400 million fine for its part in a conspiracy to fix prices for urethane chemicals.
Dow said in a March 5 filing that it wants U.S. District Court in Kansas City to decide that it was inappropriate to try the case as a class action because of a decision that the U.S. courts made in 2008 about the relevance of class actions.
Midland, Mich.-based Dow asked the court to overturn its verdict on a matter of law or re-try the case.
Dow also argued that the plaintiffs could not prove that the conspiracy actually happened, and that there was no evidence of overpayments to Dow before Nov. 24, 2000.
