BENSALEM, Pa.—The Township of Bensalem has filed a complaint against a Bensalem tire recycler for alleged environmental violations.
National Sales & Supply Inc. is a manufacturer of a wide range of recycled rubber products under the Majestic brand name, including mulch, playground surfacing and custom-molded products. The company leases a 120,000-sq.-ft. facility in Bensalem.
According to the complaint filed May 25 in the Bucks County (Pa.) Court of Common Pleas, National Sales has allowed salt-laden vapor to be discharged from its facility, killing trees and contaminating nearby Neshaminy Creek.
“The township has received numerous complaints by adjoining property and business owners and a neighboring municipality as a result of the discharge of the salt-laden vapor,” the complaint said.
The Bensalem Township fire marshal received complaints of smoke, salt and dust emanating from the National Sales plant in October and November 2010 and January 2011, according to the complaint. On Jan. 13, 2011, the fire marshal advised National Sales to stop operations.
Also, in December 2010, the Pennsylvania Department of Environmental Protection sent National Sales a notice of violation for not following the DEP's Air Quality Rules and Regulations, the complaint said.
National Sales has allowed salt-laden vapor to cover the interior of its facility, including the sprinkler system, electrical panels and equipment, acc¼ording to the complaint. The firm also failed to clean up an accumulation of debris, including overflowing trash bins and unsecured propane containers, it said.
The township seeks a preliminary injunction against National Sales from entering, leasing or doing business at the premises, as well as an order to repair all alleged damage to the property.
Judge Robert O. Baldi of the Bucks County Court of Common Pleas was scheduled to conduct a hearing on the case at his court in Doylestown, Pa.
National Sales CEO Richard Blum did not return calls.
According to the National Sales website, the process the company uses to make Majestic Rubber Mulch “helps to reduce metal and toxic elements and adds UV protection so the mulch looks good and remains clean year after year. It is so well-designed that professionals find it difficult to tell our rubber mulch apart from organic root mulch in its standard natural colors.”
In 2008, National Sales was named to the “Philadelphia 100” list of the Philadelphia area's fastest-growing small businesses.
