DENVER (May 27, 2010)—Gates Corp. said it has settled its litigation against Dorman Products, Inc. concerning marketing statements by Dorman about its automatic belt tensioners.
The May 24 agreement, approved by the U.S. District Court of Colorado, requires that Dorman and its executives may no longer use phrases such as “All SAE Specifications,” “OE Solutions,” “OE Quality” and “OE Performance” in literature or sales promotion, according to Gates.
Gates took legal action to prevent confusion in the market as to tensioner quality and performance, said David Miller, vice president of global product marketing for Gates.
