DENVER (Sept. 1, 2009)—Gates Corp. has filed a lawsuit against Dorman Products Inc. in the U.S. District Court of Colorado alleging Dorman is engaged in false advertising and unfair competition based on its advertising and sales of some aftermarket automatic belt tensioners.
It's the second suit filed by a hose and belt manufacturer against Colman, Pa.-based Dorman in the last month. Dayco L.L.C., a division of Mark IV Industries, alleged that Dorman was engaged in trade dress infringement, false advertising and unfair competition in a lawsuit it filed in early August.
Gates, part of the Industrial & Automotive group of Tomkins P.L.C. and a Denver-headquartered global hose and belt manufacturer, said it is seeking a jury trial and seeks a variety of remedies, including permanent injunction relief, monetary damages, costs and attorneys' fees. It did not elaborate further on the suit.
