ST. LOUIS, Mo. (July 11, 2008) — Flexsys America L.P. said the U.S. International Trade Commission has decided to investigate the patent infringement charge it filed in May concerning rubber antidegradants.
Flexsys filed a complaint May 12 against Chinese chemical firm Sinorgchem Co. Shandong and the South Korean companies Korea Kumho Petrochemical Co. Ltd., Kumho Tire Co. Ltd. and Kumho Tire USA Inc. The complaint covers much of the same ground as the complaint Flexsys filed with the ITC early in 2005.
That action accused Sinorgchem of making the antidegradant 6PPD and its feedstock, 4-ADPA, without Flexsys' license or permission, and its U.S. sales agent, Sovereign Chemical Co., of marketing the unauthorized chemicals in the U.S.
A Flexsys victory in the 2005 complaint was tossed out by a federal appeals court.
In the newer case, Flexsys seeks a further exclusion order barring the import of Sinorgchem's 4-ADPA as well as 6PPD made from Sinorgchem's 4-ADPA into the U.S,., including that manufactured by Korea Kumho
