CLEVELAND (June 7) — A federal court has granted the defendants a stay in a $20 million patent infringement suit brought by Flexsys America L.P.
Sinorgchem Co. Shandong, Korea Kumho Petrochemical Co. Ltd., Kumho Tire U.S.A. Inc. and Kumho Tire Co. Inc. won't have to face further action in the case until the U.S. Court of Appeals for the Federal Circuit hears their appeal of an International Trade Commission ruling that Sinorgchem made and sold Flexsys' patented antidegradants without Flexsys' permission.
Flexsys' suit was based on the ITC decision, and the company further alleges the Kumho companies violated its patents by knowingly using Sinorgchem antidegradants. Manni Li, a Los Angeles attorney for Sinorgchem, said she expected oral arguments in the ITC appeal in September or October.
Officials of Solutia Inc., Flexsys' parent company, had no immediate response to news of the stay, which was granted by the U.S. District Court for the Northern District of Ohio.
