MONTPELIER, Vt. (Aug. 14) — Vermont Gov. Jim Douglas said he is instructing the state´s attorney general to pursue an appeal of a New York Supreme Court judge´s decision rejecting Vermont´s bid to stop a test burn of tire-derived fuel in Ticonderoga, N.Y.
International Paper Co. wants to test TDF to see if it can partly replace more expensive fuels, but Vermont officials claim the burn will cause unacceptably high toxic emissions which will then waft across Lake Champlain into Vermont.
"I remain prepared to exhaust all available legal avenues to prevent this potentially toxic tire burn," Douglas said in a news release.
Currently, International Paper awaits a decision from the Environmental Protection Agency whether to approve the draft permit for the test burn issued by the New York Department of Environmental Protection.
