DEARBORN, Mich. (Aug. 25)—Ford Motor Co. won a major rollover liability case when a Cincinnati federal appeals court upheld the dismissal of a class action lawsuit.
A group of Ford shareholders, including several unions, claimed the auto maker lied to them about the safety of Firestone tires that were original equipment on Ford Explorers.
Also, Ford settled a Florida suit filed by the family of a construction worker killed while driving a company-owned Ford Explorer. The construction company replaced three of the four old Cooper tires on the vehicle with new tires of the same model; the one remaining old tire failed, causing a rollover. The jury found Ford 50-percent liable, the construction company 30-percent liable, and the driver 20-percent liable. Cooper Tire & Rubber Co. was not found liable.
