BIRMINGHAM, Ala. (Dec. 9)—A judge in the U.S. District Court for the Northern District of Alabama granted Bridgestone/Firestone's motion to dismiss a case by a motorist and his wife who claimed a Firestone Steeltex R4S tire on his truck was defective.
Judge James H. Hancock said John and Patricia Carr "submitted no evidence whatever to support their claims." Earlier Hancock granted Bridgestone/Firestone's motion to exclude the testimony of the Carrs' expert witness.
"They asked him (the expert witness) questions about the compounding and structure of a tire, and he knew nothing about them," a BFS spokesman said. The spokesman also said that Joseph L. Lisoni, the Pasadena, Calif.-based plaintiffs' attorney who leads a class action to obtain a court-ordered recall of 30 million Steeltex tires, was also the lead attorney in the Carr case. Lisoni could not be reached for comment.
