CINCINNATI, Ohio (Jan. 16)—A Cincinnati law firm has filed a class action complaint against Goodyear and its subsidiary Kelly-Springfield Tire Co. Waite, Schneider, Bayless & Chesley´s suit represents all owners of vehicles equipped with Goodyear and Kelly Load Range E tires or "who have paid to have the tires replaced," according to Troy Skeens, an attorney with the firm. The suit accuses the tire makers of unfair trade practices, breaches of express and implied warranties and related claims because of an alleged "silent recall" of the Load Range E tires. "They have reimbursed customers who complained, but they haven´t come out and said they will reimburse all owners of the tires," Skeens said. The suit asks the U.S. District Court for the Southern District of Ohio to order Goodyear and Kelly to recall the tires, and pay unspecified compensatory and punitive damages to the tire owners. A Goodyear spokesman declined comment, saying the company hadn´t yet seen a copy of the complaint.
